Domestic Violence Awareness Month

October is Domestic Violence Awareness Month, a time dedicated to raising awareness about the impact of abuse and the legal protections available to victims. A “family or household member” includes:

Florida courts recognize several types of injunctions, depending on the relationship and type of violence involved:

  1. Domestic Violence Injunction – for abuse involving a family or household member.
  2. Dating Violence Injunction – for individuals in a romantic or intimate relationship within the past six months.
  3. Repeat Violence Injunction – when there have been two or more acts of violence or stalking.
  4. Sexual Violence Injunction – for victims of sexual battery or similar offenses.
  5. Stalking or Cyberstalking Injunction – for ongoing unwanted contact or digital harassment.

How the Process Works

  2. The respondent (the accused) is served with the order and notified of a court hearing within about 15 days.
  3. Both parties can present evidence, testimony, and witnesses at the hearing before the judge decides whether to issue a Final Injunction.

What an Injunction Can Do

A Florida injunction can:

  •  Order the abuser to stay away from your home, school, or workplace
  •  Grant you temporary custody of minor children
  •  Require the respondent to surrender firearms
  •  Prohibit all contact by phone, text, or social media
  •  Provide other relief the court deems necessary for your protection

Violating an injunction is a criminal offense in Florida and can lead to arrest and jail time.
