What Will Happen to Your Pets if You Divorce?

For many families, pets are cherished members, making decisions about their custody crucial. At Anton Garcia Law, we understand the importance of addressing every aspect of divorce, including the custody of beloved pets. In this blog, we'll guide you through how pet custody works in Florida and how our experienced family law attorneys can assist you in ensuring the best outcome for your furry friends.

Understanding Pet Custody in Florida

Under Florida law, pets are considered property. This classification is based upon a 1995 case, Bennett v. Bennett. In this case, the courts explicitly differentiated the treatment of pets from that of children.

Because of this, the courts will address your pets the same way they address your other property, which means that a court cannot grant visitation or custody regarding your pets. Because of this, any shared time with the family pet must be agreed upon outside of court.

When deciding who should get the family pet, a judge may take into account several factors:

  •  Primary Caregiver:

The court often considers who has been the primary caregiver for the pet. This includes taking care of their feeding, grooming, veterinary care, and overall responsibility for the animal's well-being.

  •  Pet's Best Interest:

The court's primary concern is the welfare of the pet. This involves evaluating each party's living situation, stability, and ability to provide proper care and attention.

  •  Ownership and Purchase Agreements:

While ownership alone may not be the decisive factor, any existing agreements or documents related to the pet's ownership can influence the court's decision.

  •  Child Custody Arrangements:

If the divorcing couple has children, the court may consider keeping the pet with the parent who has primary custody of the children to maintain stability and continuity in the family unit.
