Can a Narcissist Get Custody?

If you are divorcing a high-conflict spouse, one of your biggest concerns may be what will happen to your children. You may even wonder, “can a narcissist get custody?” 

The answer is yes. Having narcissistic traits, or even a diagnosis of narcissistic personality disorder, does not automatically prevent a parent from having custody or time-sharing. Instead, Florida family courts focus on the best interests of the child and the specific circumstances of the family. 

Courts Focus on Behavior, Not Labels 

Calling your spouse a “narcissist” is unlikely to be as important to the court as being able to demonstrate specific behaviors that affect your children. 

Depending on the circumstances, relevant concerns could include: 

  • Interfering with the child's relationship with the other parent 
  • Repeatedly violating parenting agreements or court orders 
  • Exposing the child to ongoing parental conflict 
  • Refusing to communicate or cooperate about important parenting decisions 
  • Making threats or inappropriate statements 
  • Engaging in behavior that raises concerns about the child's safety or well-being 

Rather than focusing on a label, it is generally more useful to document what happened, when it happened, and how it affected your child or the parenting relationship. 

What Does Florida Law Consider? 

When establishing a parenting plan, Florida courts consider numerous factors related to the child's best interests. This can include each parent's ability to provide a stable environment, support the child's relationship with the other parent, communicate about parenting responsibilities, and protect the child's well-being. 

For parents dealing with a high-conflict relationship, a detailed parenting plan can also help establish clear expectations regarding schedules, communication, holidays, transportation, and decision-making. 

What Can You Do? 

You cannot control how your spouse behaves, but you can control how you respond. 

Keep communication focused on the children, follow court orders and agreements, maintain appropriate boundaries, and preserve relevant documentation. Most importantly, avoid putting your children in the middle of the conflict. 

If you are dealing with a high-conflict divorce, you do not necessarily need to prove that your spouse is a narcissist. The more important question is what is happening, how it affects your family, and what legal options may be available to address it.
